This Privacy Policy explains how OrdersUp ("OrdersUp," "we," "our," or "us") collects, uses, and shares information in connection with getordersup.com and the OrdersUp platform (the "Service"). It applies to two groups of people: (a) restaurant operators and staff who use the Service ("Customers"), and (b) diners and website visitors of those restaurants ("Guests").
1. Information we collect
From Customers: name, email, phone, business name, addresses, billing details (processed by Stripe — we never see full card numbers), login credentials, content you upload (menus, photos, brand assets), and information you give us to connect third-party services on your behalf.
From Guests of our Customers: name, email, phone number, order history, reservation details, review content, and messaging preferences — provided to us by our Customers so we can operate their guest CRM, marketing, and reservation tools.
Automatically: IP address, device and browser information, pages viewed, and cookies used for authentication, security, and product analytics.
2. How we use information
To provide and secure the Service; to process payments; to send transactional communications (receipts, service notices, security alerts); to help Customers communicate with their Guests; to improve the Service; and to comply with legal obligations. We do not sell personal information.
3. Guest data — our role
For Guest information, we act as a service provider ("processor") on behalf of the Customer restaurant, which is the controller of that data. Customers are responsible for having a lawful basis to collect and share Guest information with us and for responding to Guest requests about their data. If you are a Guest and want to access or delete your information, contact the restaurant you interacted with, or contact us and we will route your request.
4. Sharing
We share information with: (a) service providers who help us run the Service (hosting, database, email delivery, SMS and voice carriers, analytics, payments); (b) integration partners at your direction (Google, Meta, Yelp, Apple, delivery marketplaces, and others); (c) legal or safety recipients when required by law or to protect rights, property, and safety; and (d) acquirers in the event of a merger, acquisition, or asset sale, subject to this policy.
5. Cookies and tracking
We use cookies and similar technologies to keep you signed in, remember preferences, secure the Service, and measure product usage. You can control cookies through your browser. We do not honor Do Not Track signals at this time. If we add advertising or analytics pixels to the marketing site, they will be disclosed here.
6. Security
We use industry-standard technical and organizational safeguards, including encryption in transit, role-based access controls, and audit logging. No system is 100% secure. If we learn of a breach affecting your information, we will notify you as required by law.
7. Retention
We retain Customer account data for as long as your account is active and for a reasonable period afterward for legal, tax, and operational purposes. Guest data retention is controlled by the Customer restaurant. You may request deletion at any time by emailing us.
8. Your choices and rights
You may access, update, or delete most information from your OrdersUp account settings. Depending on your state (California, Colorado, Virginia, Connecticut, Utah, and others), you may have additional rights, including the right to know, delete, correct, and opt out of certain processing. To exercise these rights, email
privacy@getordersup.com. We will not discriminate against you for exercising your rights.
9. Children
The Service is not directed to children under 13, and we do not knowingly collect personal information from them.
10. International users
The Service is operated from the United States. If you access it from outside the U.S., you consent to the transfer and processing of your information in the U.S.
11. Changes
We may update this policy from time to time. If we make material changes, we will notify you by email or in-app notice before they take effect.
